PERSONAL DATA AND INFORMATION PRIVACY NOTICE

1.      Responsible for the personal data protection.

Pérez Olvera Enríquez Asociados, S.C., located at Avenida Paseo de la Reforma # 146, Lomas del Marqués, in the city of Querétaro, in the state of Querétaro -hereinafter referred to as POE Consultores-, acknowledges the importance of legitimate, controlled, and informed treatment of your personal data.

This Privacy Notice is made available to you in order to inform you of the practices of POE Consultores when obtaining, using, disclosing, or storing your personal data, pursuant to the provisions of the Federal Law for the Protection of Personal Data Held by Private Parties (hereinafter the «Law»).

1.      Information that is collected.

 

POE Consultores is committed to safeguarding confidentiality, in terms of the Federal Law for the Protection of Personal Data Held by Private Parties and informs you that the data collected are only those required to fulfill the purposes mentioned in this Notice, and our personal data processing practices are consistent with the provisions of the aforementioned Law and its Regulations in force.

 

In addition, POE Consultores agrees not to disclose, sell, transmit, transfer, or exchange by any means your personal database without your prior consent. However, POE Consultores may transfer your personal data when such transfer is set forth in the Law, or in the event that federal, state, or municipal authorities of executive, legislative or judicial branch request it in the exercise of their authority or powers.

 

Exceptions. POE Consultores may be required to disclose your personal data under any of the following circumstances, including, but not limited to:

·         By request of the Tax Administration Service (SAT)

·         By request of any Institution of the State or Federal Judicial Power.

·         By formal petition of any of the voting Partners

 

The personal data subject to processing are as follows:

·         Identification:

1.      Name, denomination, or corporate name;

2.      Federal Tax ID Number;

·         Address for tax purposes;

1.      Unique Population Registry Code (CURP).

·         Contact information:

1.      Email address;

2.      Landline and/or mobile telephone number including the long-distance area code;

·         Property and financial data:

1.      The last four digits of the bank account number, credit or debit card with which the payment of the service is made and other data of the same nature; and/or

2.      Bank account number and standardized bank key number.

III. Purposes of your personal data processing

Personal data you provide to POE Consultores are used to:

1.      Provide access to the digital consultation service by electronic media;

2.      Issue digital tax receipts;

·         Identify, record, or process your digital traffic or financial transactions;

1.      Respond to requests for technical support, comments, suggestions, or complaints;

2.      Provide you with any information you request and in general to comply with the liabilities arising from the relationship that may be agreed or contracted with you.

1.      Measures established for protection of personal data.

In order to ensure the correct collection and processing of personal data, POE Consultores redefines new operational and administrative processes related to the collection, access, use, modification, protection, deletion, and/or blocking of personal data, including assigning a person responsible for that within the company and training of the personnel involved in these processes.

1.      Use of cookies and web beacons.

Cookies and web beacons deployed to obtain data on user preferences, device features, and browsing software used when the Owner browses the Internet can be blocked or deleted following the specific instructions of the manufacturer of the graphical Internet browser that is used.

 

 

1.      ARCO Rights and their exercise.

The Owner of the personal data may exercise the ARCO Rights (Access, rectification, cancellation, and opposition) regarding the processing of their personal data that were collected

Requests for access, rectification, cancellation, or opposition shall be sent to the following email address oaperez@poeconsultores.com.mx and contain the following:

1.      Owner´s name and address or other means of communicating the response to their request;

2.      Documents proving identity or, as the case may be, legal representation of the Owner;

·         A clear and precise description of the personal data in respect of which the exercise of any of the aforementioned rights is sought, and

1.      Any other element or document that facilitates the localization of the personal data.

POE Consultores will process the requests of the Owners for the exercise of the rights referred to in the Law.

In the case of rectification requests, the Owner must indicate, in addition to the aforementioned, the modifications to be made and provide the documentation that supports their petition. POE Consultores will communicate to the Owner, within a maximum period of twenty business days from the date on which the request was received, the determination adopted, so that, if it is applicable, it becomes effective within fifteen business days following the date on which the response is communicated.

VII. Consent Withdrawal.

For us to stop using your personal data, consent may be withdrawn at any time, without retroactive effect. To withdraw your consent, send your request providing an accurate description of the consent you would like to withdraw to the following email: oaperez@poeconsultores.com.mx containing the following information:

 

 

1.      Owner’s name and address or other means of communicating the response to your request;

2.      Documents proving identity or, as the case may be, legal representation of the Owner;

·         Explanation of the reasons why you wish to withdraw your consent to the processing of your information.

Within a maximum period of twenty business days from the date on which the request was received by Pérez Olvera Enríquez Asociados, S.C., we will respond to your petition and will inform you about its admissibility replying to the same email in which you sent us your petition.

 

 

 

 

VIII. Alternative Rights.

If you consider that your right to protection of personal data has been infringed by any conduct, and you consider that the processing has violated the provisions of the Law, you may file the corresponding complaint or claim with the IFAI [Spanish acronym for Federal Institute of Access to Public Information and Data Protection], for more information visit www.ifai.org.mx

1.      Limit the use or disclosure of personal data.

You may limit the use and disclosure of your personal data by registering your data in the Public Registry of Users of Financial Services referred to in the Federal Law for the Protection of Personal Data Held by Private Parties at the following link www.condusef.gob.mx
